Petitioner is aggrieved by the fact that an information was furnished with the police authorities of Kotwali Police Station against the respondent no.7. To that effect, Kotwali Police Station Case No.1301 of dated 26.11.2014 was registered for investigation and the police report reflects that charge-sheet was submitted after the investigation having been concluded.

However, the present grievance of the petitioner is that the warrant of arrest issued by the learned Chief Judicial Magistrate till date did not yield any result and the accused is evading the process of law.

The police report reflects that on 31st January, 2024 the warrant officer prayed before the learned court for issuing of proclamation and attachment in respect of the absconding accused,

namely, Ashok Kumar Dey. The said order was also affected and a nil seizure list was prepared pursuant to the attachment order having been given effect to by the police authorities.

Having considered that the accused is still absconding as has been submitted by the learned advocate appearing for the petitioner, the Additional SP/SDPO in-Charge of Kotwali Police Station will monitor in respect of tracing out of the accused and produce him before the jurisdictional court in seisin of Kotwali Police Station Case No.1301 of 2014. With the aforesaid observations, WPA 5059 of 2025 is disposed of.

There will be no order as to costs.

Petitioner is granted liberty to communicate this order to the learned CJM, Paschim Medinipur. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
