Petitioner alleges of illegal encroachment in her property and to that effect informed the concerned police station. The concerned police station even after receipt of the representation/communication did not take any appropriate steps.
Learned advocate for the respondent nos. 5 to 8 submits that the petitioner is attempting to invoke the jurisdiction under Article 226 of the Constitution of India for the police authorities to act in his favour without having a right under the law. State has submitted a report. Report reflects that police authorities have drawn up
proceedings under section 126 BNS. Since the nature of the dispute complained of is a subject matter to be decided by the civil court, I am of the view that the police authorities would only oversee by ensuring that there is no breach of the peace and/or tranquility and/or any untoward incident resulting from the strained relationship existing between the parties.
With the aforesaid observations WPA 5082 of 2025 is disposed of.
