And In Re : Motaleb Seikh @ Mottaleb Ali ...... petitioner Mr. Arnab Chatterjee ...for the petitioner Mr. Ashok Das ...for the State Court is informed that the police filed final report as to mistake of fact. Final report is yet to be accepted by the Jurisdictional Court.

In such circumstances, we find that the present application be not maintainable.
