Mr. Raj Kumar Sain, learned Advocate appears for the petitioner.

Mr. Chandi Charan De, learned Additional Government appears for the State-Respondents. The petitioner claims a long term lease in respect of a public land. The petitioner has submited its representation dated October 7, 2024 before the concerned authority.

Considering the case made out in the writ petition, this Court is of the view that the writ petition is not maintainable and the petitioner shall have to initiate appropriate proceeding before the jurisdictional Land Reforms and Tenancy Tribunal.

Accordingly, the petitioner shall be at liberty to initiate the appropriate proceeding before the jurisdictional Land Reforms and Tenancy Tribunal within a period of three weeks from date.

In the event, such an application is filed before the Tribunal, the jurisdictional Tribunal after granting an opportunity of hearing to the parties thereto and by passing a reasoned order in accordance with law shall dispose of the same as expeditiously as possible.

It is made clear that this Court has not gone into merits of the writ petition. The petitioner shall be at liberty to urge whatever points he wishes to urge by relying upon whatever records and documents he wishes to rely upon before the jurisdictional Tribunal.

Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents With the above observations and directions, this writ petition, WPA 5048 of 2025 stands disposed of, without any order as to costs.
