The subject matter of the revisional application relates to an order dated 17th February, 2023 passed by the learned Executive Magistrate, 2nd Court, Sadar, Hooghly in M.P. Case No.192 of 2023. Having regard to the factum that the said order was passed on 17th February, 2023 and more than six months have passed since the order being passed, I am of the opinion that the proceedings under Section 144 of the Code of Criminal Procedure has lost its force and become infructuous. As such, no interference is called for.

Petitioner would be at liberty to approach the civil court for appropriate remedies in view of the nature of the allegations which have been made in the application under Section 144 of the Code of Criminal Procedure.

With the aforesaid observations, CRR 770 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
