Abbas Mondal @ Tanesur Mondal And ANR v. Goutam Acharjee

2022-01-06Hon'Ble Justice Sabyasachi Bhattacharyya2 pages

06th January, (AK) 42-43 CPAN 205 of 2021 With WPA 10139 of 2020 (Via Video Conference) Abbas Mondal @ Tanesur Mondal and another Vs.

Mr. Goutam Acharjee Md. Sarwar Jahan ...for the petitioners.

Mr. Susovan Sengupta ...for the alleged contemnor.

Learned counsel for the petitioners submits that although the respondent no.5 in the original writ petition took initial steps by sending appropriate eviction notice on the unauthorized occupants in terms of the order dated December 11, 2020 passed in WPA 10139 of 2020, subsequently there has been laxity on the part of the alleged contemnor, inasmuch as the matter has not been taken to its logical culmination by referring the matter to the appropriate authority after such notice.

However, it is beyond the charter of this court, sitting in contempt jurisdiction, to monitor the entire proceedings after the steps have been initiated by the alleged contemnor in compliance with the order. In the event the petitioners are aggrieved with subsequent inaction of the alleged contemnor, it will be

open to the petitioners to prefer a fresh writ application for redressal of such grievance.

CPAN 205 of 2021 is dismissed with the above observations.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
