Petitioner seeks bail.

Considering the fact that commercial quantity of narcotic was seized from the joint possession of the petitioner, we are of the view that the petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985. Consequently, we are unable to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.

The Court is informed that the prosecution is adducing their evidence and today is fixed for recording evidence on behalf of the prosecution.

The trial court is requested to adhere to the provisions of Section 309 of the Code of Criminal Procedure for fixing consecutive dates of hearing. The trial court is also requested

not to grant any unnecessary adjournments to any of the parties.

C.R.M. (DB) 768 of 2022 is dismissed.
