Despite service of notice, the respondent no. 6 is not represented. Affidavit of service is taken on record. By an order dated 31st January, 2017 the Additional District Magistrate (G), Howrah and DKMA, RSBY, Howrah has directed the ICICI Lombard to make payment in respect of 37 rejected claims within seven days of receipt of the said order.

The petitioner no. 1, hospital provides health services to the poor and needy persons in rural areas. In those circumstances, the ICICI Lombard shall make payment within a period of fifteen days from receipt of a copy of this order, as directed in the order dated 31.01.2017 passed by the learned Additional District Magistrate (G), Howrah and DKMA, RSBY, Howrah.

In default of payment by the ICICI Lombard, the petitioner shall be entitled to execute the said order as a decree of a civil court.

With the aforesaid observations, the writ petition is disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order on usual undertakings.
