The State of West Bengal and ors.

1. None appears on behalf of the petitioner on call. No accommodation is sought for.

2. This case pertains to the year 2010. Almost 15 years have already passed.

3. On 26.06.2012, the co-ordinate Bench directed the matter go out of the list.

4. On 10.09.2025, none appears on behalf of the parties on call. The matter was adjourned for end of justice.

5. On 17.09.2025, the matter was again adjourned on the prayer of learned counsel for the petitioner.

6. The instant writ petition has been filed by the writ petitioner seeking direction upon the Additional District Inspector of Schools (SE) Alipurduar along with the other respondents thereto and/or their agents not to declare the panel as invalid after expiry of the 12 months from the date of preparing of the said panel due

to the pendency of the said Civil Suit being Title Suit No. 108 of 2009 unless the learned Civil Judge (Junior Division) Alipurduar quashed the said panel in the meantime.

7. Considering the nature of prayer and long pendency of this case, this court finds it is settled law that panel remains valid for one year. Apart from that, already 15 years passed. Accordingly, such panel has become invalid.

8. Consequently, the instant writ petition being WPA 3588 of 2010 is dismissed without any order as to costs.

9. Consequently, the connected application, if any, is also, thus, disposed of.

10. Interim order, if any, stands vacated.

11. All parties shall act in terms of the server copy of this order duly downloaded from the official website of this Court.

12. Urgent certified photocopy of this order, if applied for, be supplied to the parties taking all legal formalities.
