Petitioner is aggrieved by the fact that although he is in custody for about one and half years yet till date no witness has been examined.

Learned advocate for the petitioner submits that charge has been framed on 21st February, 2024 and the schedule of dates have been fixed by the learned trial court in the month of June, 2024.

It has also been pointed out that there are eight witnesses on which the prosecution would rely upon to prove its case. Having regard to the period of detention of the petitioner and the fact that no witness has been examined till date, I direct the learned special court to fix a schedule consisting of three dates and fix such schedule once in a month so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. The Superintendent of Police of the concerned District may

be informed to ensure the availability of the witness or submit a report regarding the reasons for non-availability. No lame excuse be given for absence of any witness.

The Public Prosecutor appearing in the case would produce the materials, documents and exhibits on the dates fixed for examination of the witnesses concerned.

It is further directed that the trial of the case would continue in spite of the resolution of the local bar and the learned participating/representing advocate would not stall the proceedings because of any such resolution.

All efforts be taken by the stake-holders to conclude the trial at the earliest.

With the aforesaid observations, the present revisional application being CRR 805 of 2024 is disposed of. Pending applications, if any, are consequently disposed of.
