This is an application seeking an expeditious disposal of a proceeding under Section 125 of the Code of Criminal Procedure. Learned Counsel appearing on behalf of the petitioner submits as follows. The petitioner is the wife of the opposite party no.2. She had filed an application under Section 125 of the Code praying of maintenance allowance as also an application for interim maintenance in February, 2021. Till date, even the prayer for interim maintenance could not be decided by the learned Magistrate. The impugned proceeding has remained pending for no fault on the part of the present petitioner. I have heard the submissions of the learned counsel appearing on behalf of the petitioner and have perused the revision petition.

No prejudice will be caused to anyone, if a direction is passed in respect of the prayer to expedite the hearing in this case. It appears that the petitioner had filed an application praying for maintenance allowance under Section 125 of the Code in February, 2021. At least the prayer for interim maintenance of the wife/petitioner should have been considered by the learned Trial Court by now.

preferably within a period of three months from the next date of hearing. With the above observations, the revisional application is disposed of.
