Exception of the petitioner to the report filed by the insurance company in Court be taken on record.

The insurance claim of the petitioner has been repudiated. It appears from the submission made on behalf of both the parties that there are several issues some of which are factual to be adjudicated for providing relief to the petitioner. 3.

According to the insurance company, the petitioner did not submit all documents in support of its claim. To this, it is submitted on behalf of the petitioner that all necessary documents sought for by the insurance company were supplied.

Nevertheless, for ends of justice, the insurance company is directed to intimate the petitioner once again the required documents for processing the claim so that it can be resubmitted by the petitioner.

On resubmission, the respondent authority is directed to reconsider the prayer of the petitioner for processing the insurance claim strictly in accordance with law, after giving reasonable opportunity of hearing to the authorized representative of the petitioner. Steps shall be taken at the earliest but positively within a period of eight weeks from the date of communication of this order.

Both the writ petitions stand disposed of.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, shall be made available to the parties.
