The petitioner's application for transfer has been rejected on different grounds on different occasions.

Firstly, on the ground that the petitioner is hit by 10% rule, secondly, on the ground that the pupil teacher ratio will fall and, thirdly, on the ground that the new teacher has not joined in as yet.

The aforesaid are not grounds for rejection of the application for transfer under the 2015 Rules. Despite service of notice, the school is not represented. On the contrary, the school has refused the petitioner's notice.

In that view of the matter, the Head of the Institution shall forward the petitioner's application for transfer to the concerned District Inspector of Schools for further consideration in terms of the 2015 Rules within a period of two weeks from the date of

receipt of a copy of this order. The authorities shall thereafter deal with the petitioner's application within a period of six weeks.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
