Swarna Sen Mr. Soumosree Chatterjee Mr. Dipanjan Chatterjee Mr. Dibyendu Bhattacharya Mr. Prateep Bera Ms. Kakan Das Ms. Rimpa Adhikari ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the husband praying for a direction upon the learned Additional District Judge, 5th Court, Alipore to dispose of Matrimonial Suit No.288 of 2022 expeditiously. The learned advocate appearing for the petitioner submits that no order directing payment of any alimony has been passed either in the Matrimonial Suit or before any other forum under any other statute.
In view of the order sought and proposed to be passed this Court feels that there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate on record of the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocates representing the opposite parties before the learned Trial Judge.
From the order sheets appended to the civil revision application this Court finds that January 17, 2025 was fixed for further cross-examination of PW 1.
The learned advocate appearing for the petitioner submits that April 22, 2025 is the date fixed for further cross-examination of PW 1 as the cross-examination could not be concluded on that date and a further date has been fixed.
In the light of the aforesaid submissions made by the learned advocate for the petitioner CO 774 of 2025 is disposed of by requesting the learned Additional District Judge, 5th Court, Alipore to dispose of the Matrimonial Suit No.288 of 2022 as expeditiously as possible without granting any unnecessary adjournments to either of the parties.
There will be no order as to costs.
