Learned advocate appearing for the petitioner intends to withdraw the present revisional application which, according to the learned advocate, has been wrongly filed. Learned advocate submits that the subject-matter relates to an order of acquittal passed by the learned appellate court in respect of a proceeding under Section 138 of the Negotiable Instruments Act for which ordinarily an application under Section 378 of the Code of Criminal Procedure should have been preferred before this Court.
In view of the prayer so advanced, the revisional application being CRR 870 of 2022 is dismissed as not pressed.
Pending connected application, if any, is consequently disposed of.
The petitioner is granted liberty to take back the certified copy from the department after the same being replaced by photostat copy.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
