1. This contempt application has been filed alleging willful disobedience of the order and direction passed on 31.07.2023 in WPA(P) 375 of 2023. The operative portion of the order reads as follows:

"4. Since the matter is pending before the 7th respondent, without going into the merits of the allegations made by the writ petitioners, we direct the 7th respondent to consider the representation submitted by the petitioners on 17.05.2022 after notice to the writ petitioners as well as the 8th and 9th respondents and proceed to take action in accordance with law.

5. The above direction may be complied with within a period of eight weeks from the date of receipt of the server copy of this order."

2. As could be seen from the annexures to the contempt application, the Block Development Officer, Joynagar Block-I, Baharu, the respondent no. 7 herein has issued notice to the petitioner as well as others on 17.10.2023 and has passed an order on 18.09.2023 and taken up the matter on several dates and passed a final order on 10.10.2023, copy of which has been annexed alongwith this contempt application. In this application, various grounds have been raised by the applicant touching upon the merits of the matter.

3. Hence, this contempt application is disposed

of giving liberty to the applicant to challenge the order passed by the concerned Block Development Officer dated 10.10.2023, if so advised.
