Mr. Chatterjee, learned advocate appearing on behalf of the petitioner files photocopy of the relevant papers relating to the Fixed Deposit Account opened by his client in terms of the order dated July 13, 2022. The said papers are taken on record. The condition since has been complied with the further proceedings of the connected execution case being Money Execution Case No. 6 of 2019 pending before the Commercial Court at Alipore, District. 24-Parganas (South) is stayed till the disposal of the proceeding under Order IX Rule 13 of the Code of Civil Procedure being Misc. Case No. 02 of 2022, pending before the said Court. In view of the aforesaid, the direction passed by the Executing Court in the order impugned dated February 14, 2022 for attachment of the bank account of the petitioner bank is also set aside. The Court below is requested to expedite the disposal of the said Misc. Case No.2 of 2022 as expeditiously as possible. C.O. 606 of 2022 is disposed of with the above terms without any order as to costs.
