Petitioners have challenged the chargesheet submitted in connection with Raghunathganj P. S. Case No. 776 of 2023 dated 15-09-2023 wherein the Investigating Agency has charged the petitioners under Sections 498A/448/323/34 IPC and under Section 4 of the D. P Act. None of the documents under Section 207 of the Code of Criminal Procedure which is the foundation of the chargesheet has been enclosed along with the revisional application.

Having considered the narration in the brief facts of the case, the cognizance order at this stage cannot be considered or interfered with.

Petitioners would be at liberty to canvass all the issues at the stage of Section 239 of the Code of Criminal Procedure before the learned jurisdictional Magistrate in seisin of the matter. Needless to state that the learned Magistrate independently would consider the issues so placed without being

influenced by any observations made by this court. With the above observations, the present revisional application being CRR 808 of 2024 is disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
