01.03.2024 sdas rejected C.R.M.(DB) No. 655 of 2024 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Entally Police Station Case No. 172 of 2023 dated 05.06.2023 under Sections 307/379/411 of the Indian Penal Code.

And In Re : Md. Danish .... petitioner Ms. Sreyashee Biswas Ms. Puja Goswami ....for the petitioner Mr. Binay Panda Mr. Subham Bhakat ... for the State 1.

Learned Counsel for the petitioner submits he is in custody for 265 days. It is also submitted there is a case and counter case. He prays for bail.

Learned Counsel for the State opposes the prayer for bail and submits petitioner has criminal antecedents. 3.

We have considered the materials on record.

Petitioner had stabbed the victim and snatched away Rs.35,000/- and a mobile phone. Date has been fixed for consideration of charge. There is possibility of abscondence in the event petitioner is released on bail.

Under such circumstances, we are not inclined to grant bail to the petitioner at this stage.
