Ct. No.34 CRR 771 of 2020 Sanjay Dey vs.

Smt. Rupa Dey nee Chakraborty The revisional application was preferred challenging the order dated April 11, 2019 passed by the learned Judicial Magistrate, 1st Class at Kalyani, Nadia in connection with Mis. Case No. 196 of 2018.

The order reflects that learned Magistrate on consent in a joint petition passed the order directing payment of a sum of Rs.5,000/- towards maintenance for the minor daughter Rusha Dey from the date of filing of the application that is on 13th September, 2018.

I have perused the contention advanced in the revisional application and I find that the reasons so assigned in the revisional application are after thought which cannot be accepted in law.

Learned Magistrate after allowing the maintenance of the minor daughter has categorically observed that the same would be subject to adjustment if any, payment is made under any other statute.

In view of the reasons, so assigned by the learned Magistrate, I am of the opinion that no interference is called for in respect of the order under challenge.

Accordingly, CRR 771 of 2020 is dismissed.

All pending applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
