1. As prayed for by learned advocate appearing for the petitioner, leave is granted to the petitioner to implead the Secretary, Kolkata Port Trust as a party respondent in this writ petition.

2. Affidavit in reply is filed in Court and the same is taken on record.

3. None appears for the Kolkata Port Trust authority. A photocopy of the affidavit in opposition served upon the petitioner by the Kolkata Port Trust authority is kept on record.

4. The petitioner claims that his father, who was an employee of the Kolkata Port Trust died in harness on 30th April, 2012. The petitioner claims to have applied for appointment on compassionate ground on

November 26, 2012. The petitioner submits that the petitioner has not been communicated any decision of the authorities as to the fate of such application. It appears from the letter dated 17th January, 2013 that the application of the petitioner was forwarded to the Secretary of the Kolkata Port Trust authority for enlistment the name of the petitioner as a died in harness candidate. Since the authorities have not communicated its decision as to whether the name of the petitioner has been listed or not, this writ petition is disposed of by directing the Secretary, Kolkata Port Trust being the added respondent to communicate its decision with regard to the prayer for appointment on compassionate ground as expeditiously as possible but positively within a period of four weeks from the date of receipt of server copy of this order.

5. With this above direction/observation, the writ petition stands disposed of.

6. There will be no order as to costs.

7. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
