Court No.06 265719 CO 777 of 2025 Merry Gupta -Vs- Pranab Chandra Dey Mr. Debasis Kar Mr. Arka Tilak Bhadra .....For the Petitioner This application under Article 227 of the Constitution of India is at the instance of the wife praying for a direction upon the learned Additional District Judge, 11th Court at Alipore, South 24 Parganas to dispose of the application under Section 36 of the Special Marriage Act praying for alimony pendente lite filed in connection with Matrimonial Suit No. 1884 of 2015.

The learned advocate for the petitioner submits that the application under Section 36 of the Special Marriage Act was filed on 5th of April, 2024 and the next date has been fixed for hearing of such application on 10th of March, 2025. The learned advocate for the petitioner submits that the application under Section 36 of the Special Marriage Act is otherwise ready for hearing.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of notice upon the opposite party. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application, along with a copy of this order, upon the

opposite party or his learned advocates representing him before the learned trial court.

Since it has been submitted that the application for alimony pendente lite is otherwise ready for hearing and 10th of March, 2025 has been fixed for hearing of such application, CO 777 of 2025 stands disposed of by requesting the learned Additional District Judge, 11th Court at Alipore, South 24 Parganas to dispose of the application under Section 36 filed in connection with the Matrimonial Suit No. 1884 of 2015 as expeditiously as possible preferably by the end of June, 2025 without granting any unnecessary adjournment to either of the parties.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties after compliance of all necessary formalities.
