Learned advocate appearing for the petitioner submits that there has been change of circumstances. Learned advocate for the defacto complainant also consents to the submissions advanced by the petitioner.

Learned advocate for the State has produced the case diary. The facts in the case diary state otherwise. Consequently, I direct that if there are change of circumstances, petitioner and the defacto complainant will approach the learned Trial Court who at the relevant stage would give priority for recording the evidence of the victim and thereafter exercise his discretion in accordance with law.

At this stage, I am not inclined to release the petitioner on bail.

Accordingly, CRM (M) 605 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
