Mr. Usof Ali Dewan Mr. Asif Dewan ... for the petitioner Mr. Biswabrata Basu Mallick Mr. Sanjib Das ... for the State The petitioner seeks compassionate appointment. Her father was a Gram Panchayat Karmee who died in harness on 30th September, 2017.

The petitioner along with other legal heirs claims to have make representation before the Block Development Officer, Raghunathganj-II Development Block on 23rd February, 2018 praying for providing appointment on compassionate ground under the died in harness category.

The petitioner alleges that the same has not been taken up for consideration till date.

Be it recorded that at the time of death of the employee he was survived by his widow and children. The mother of the petitioner, i.e. widow of the deceased employee, also died on 19th July, 2020.

As it appears that the representation filed by the petitioner praying for compassionate appointment is pending consideration at the end of the Block Development Officer, accordingly, the present writ petition is disposed of by directing the respondent no.5 to consider the prayer of the petitioner for providing appointment on compassionate ground under died in harness category strictly in accordance with law, at the earliest, but positively within a period of eight weeks from the date of communication of this order.

The aforesaid respondent shall pass a reasoned order and communicate the same to the petitioner immediately thereafter.

The petitioner is directed to forward a copy of the application made for providing appointment on 23rd February, 2018 to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.

Affidavit of service filed in Court is taken on record.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
