C.R.M. (DB) 846 of 2025 In Re : An Application under Section 439 of the Code of Criminal Procedure/under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Dasnagar Police Station Case No. 358 of 2015 dated 30.09.2015 under Sections 448/302/34 of the Indian Penal Code and Sections 25/27 of the Arms Act.

Mr. Suman De Afreen Begum ... For the State.

The petitioner is in custody for more than 9 years and renews his prayer for bail.

Learned counsel for the State opposes the prayer. The bail prayer of the petitioner was turned down on merits earlier. It is also found that the petitioner has used a mobile phone even in custody. There is sufficient evidence prima facie connecting the petitioner to the alleged offence. Conviction may attract mandatory life imprisonment. In view of the above, prayer for bail is rejected at this stage.

Learned counsel for the State submits that four more witnesses are remaining to be examined. Learned trial Court is directed to expedite the trial and conclude the same as early as possible, without granting any unnecessary adjournment to either of the parties, in accordance with law.
