Riton Sk & ANR v. State Of West Bengal
rkd 09.02.2021 Ct. no.32 C.R.R. 779 of 2020 In the matter of: Riton Sk. &Anr.
....petitioners.
Mr. K. M. Rahaman ...for the petitioners.
Mr. P. K. Dutta, Mr. S. Roy ...for the State.
This is an application seeking a stay of warrant of arrest issued against the petitioners so that the petitioners can surrender and pray for bail.
A copy of the application is served upon Mr. Dutta and Mr. Roy, learned advocates who ordinarily appear on behalf of the State. They are requested to appear in the matter. Their engagement be regularised by the competent authority of the State.
Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners were in bail in connection with the present case since 2019. Only on a few occasions the present petitioners could not attend the court due to unavoidable reasons and a warrant of arrest was issued against them. The petitioners want to join the proceeding at the earliest. I have heard the submissions of the learned counsels appearing on behalf of the petitioners and the State and have perused the revision petition.
It appears that the petitioners want to join the proceeding at the earliest.
In view of the above and in the interest of justice, I direct that the warrant of arrest issued against the petitioners shall remain stayed for a period of four weeks from this date. The petitioners are directed to surrender before the learned trial court within the said period of four weeks. In the event the petitioners surrender before the learned trial court within such time, their application for bail shall be considered in accordance with law.
With these observations, the revisional application is disposed of.
Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Jay Sengupta, J.)
