Mr. Tarak Nath Halder ... for the petitioner This application under Article of the Constitution of India is at the instance of the plaintiff no.1 in a suit for declaration of title and permanent injunction praying for a direction upon the learned Civil Judge (Junior Division), First Court at Baruipur, to dispose of the Title Suit No. 538 of 2024 expeditiously. When this matter is taken up for hearing, Mr. Halder learned advocate for the petitioner submits that the learned trial judge by an order dated 27th January, 2025 fixed 10th June, 2025 for hearing of injunction application. The petitioner herein filed a petition praying for pre poning the said date of hearing and such prayer was rejected by order dated 6th February, 2025. Since the ad interim order of injunction was passed on 25th July, 2024 and it has been submitted by Mr.

Halder, learned advocate for the petitioner that the injunction application is otherwise ready for hearing, C.O. 780 of 2025 is disposed of by giving liberty to the petitioner to file an application for pre poning the date of hearing of injunction application before the learned trial judge.

will consider such application after giving an opportunity of hearing to the contesting opposite party and pass orders accordingly.
