Heard learned counsels for the parties.

The petitioner has prayed for quashing of the criminal proceedings initiated against him being Case no.

CS/1829/2023 under Section 25(1) of the Payment of Settlement Systems Act, 2007 read with Chatper XVII of the Negotiable Instruments Act, 1881 pending before the learned 4th Metropolitan Magistrate, Calcutta.

Learned counsel for the opposite party submits that the said case has been withdrawn by the opposite party on 31st March, 2023.

The petitioner seeks return of the five signed blank security cheques lying with the opposite party. Learned counsel for the opposite party submits that the said cheques shall be returned to the petitioner upon submission of a proper application by him.

In view of the above, nothing further remains to be adjudicated in the revisional application andthesame being CRR 780 of 2023 is disposed of with liberty to the petitioner to

submit an application before the opposite party for refund of the cheques lying before it.

The opposite party shall refund the said cheques within two weeks from the date of receipt of the application. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
