1. Let affidavit-of-service, as filed in Court, be kept on record.

2. In spite of service, none appears on behalf of the school authorities.

3. The petitioner is aggrieved that his application for transfer on the medical ground of his spouse has not been recommended till date.

4. Mr. Mitra, learned Advocate appearing for the Commission, submits that they have no objection in considering the prayer of the petitioner, provided the petitioner indicates the preferences for the three schools. The petitioner in Prayer-D of the petition has indicated three schools and the Commission will consider the third school, as entailed in Prayer-D of the writ petition.

5. Respondent no. 3 is directed to consider the prayer of the petitioner by April 30, 2026 and intimate the petitioner about the resultant order of consideration by April 30, 2026.

6. Application of the petitioner will be considered in the light of the preferences given by him and if no vacancy is available in the three preferences given by him, in any other school in close proximity to his place of residence.

7. The suspension of 'Utsashree Portal' will not be an impediment for the concerned authority to consider the application for transfer of the petitioner. The same shall be considered in an offline mode.

8. With the aforestated directions, the writ petition is, thus, disposed of.

9. There shall, however, be no order as to costs.

10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
