The petitioner is the mother-in-law of the defacto complainant. The allegation against the petitioner is under Sections 498A/406/354(B) of the Indian Penal Code and Section 4 of the Dowry Prohibition Act. The petitioner says that she is innocent and has been falsely implicated. The State produces the case diary including the statements of witnesses.

We have considered the material in the case diary. The allegations against the petitioner are general and omnibus in nature.

In view of the material in the case diary and the nature of the allegations, we are inclined to hold that the petitioner may be granted anticipatory bail so long as she cooperates with the Investigating Officer.

Accordingly, in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand), with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer of the concerned police station and shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure until further orders and on further condition that the petitioner shall not enter the jurisdiction of Gurap Police Station until further orders. The petitioner shall also furnish the address where he will be residing to the Investigating Officer. The application for anticipatory bail being CRM 2209 of 2021 is, thus, allowed.
