2) Mr. Piyush Chaturbedi, learned Senior Advocate representing the petitioner submits that petitioner has suffered an order of punishment to the extent of stoppage of two increments vide final order dated 1st April, 2024 passed by the President, Ad hoc Committee, West Bengal Board of Secondary Education. It is further submitted that being aggrieved by said order of punishment dated 1st April, 2024 petitioner preferred appeal before the Commissioner of School Education on 26th

February, 2025 in terms of Rule 10 of the West Bengal Board of Secondary Education (Appointment, Confirmation, Conduct and Discipline of Teachers and Non-Teaching staff) Rules, 2018.

3) It is pointed out on behalf of the petitioner that in terms of Rule 10(4) of the said Rule of 2018 Appellate Authority is required to decide the appeal within ninety days from date of filing appeal. It is submitted that though appeal was preferred on 26th February, 2025 till date same has not been decided.

4) Respondents are represented by learned advocates.

5) Having considered the case made out in this writ petition, writ petition stands disposed of directing the Commissioner of School Education being Appellate Authority to dispose of the appeal preferred by the petitioner by eight weeks from the date of communication of this order.

6) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
