None appears on behalf of the Sadharaner Siddiquia High Madrasah.
The petitioner is a retired teacher of the said Madrasah. He is not getting his retiral dues as the information sought for by the District Inspector of Schools (S.E.), Howrah from the head of the institute of the said Madrasah by communicating memo dated 14th February, 2022, has not been supplied till date. The petitioner retired from service on 31st March, 2008. He is yet to receive his terminal benefits. As it appears that the Madrasah is not responding to the request sent to the head of the institute way back in February 2020, accordingly, the District Inspector of Schools (S.E.), Howrah is directed
to depute a competent person to visit the institution and collect the relevant data required for the purpose of processing the pension file of the petitioner from the Madrasah.
The aforesaid shall be done within a period of three weeks from the date of communication of a copy of this order.
On receipt of the information as required, the District Inspector of Schools (S.E.), Howrah shall take all necessary follow up steps so that the petitioner may receive his retiral dues at the earliest.
The District Inspector of Schools (S.E.), Howrah is also directed to take appropriate steps against the erring official of the Madrasah for not replying to the request sent by the District Inspector of Schools (S.E.), Howrah and sitting tight over the matter due to which the teacher is unable to receive his terminal benefits long after his retirement.
The District Inspector of Schools (S.E.), Howrah shall ensure that the teacher receives his retiral dues latest within a period of six months from the date of receiving all documents from the Madrasah.
The writ petition stands disposed of.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
