Mr. Pinak Kumar Mitra Mr. Kaustav Talukdar ... for the Petitioner(s) Mr. Jaydeep Biswas Mr. Sachit Talukdar ... for the State-respondent(s) Learned advocate for the petitioner submits that on the basis of statement of a co-accused, the petitioner has been arrested and the only evidence which is against the present petitioner is from the statement of a co-accused so far as the account was used for extorting the money. Learned advocate for the State opposes the prayer for bail and submits that the petitioner convinced the other accused who is also in custody, namely, Manish Kumar. Having regard to the nature of the materials available in the present case; the complicity of the present petitioner and the fact that the petitioner is in custody for about six months, I am of the view that further detention of

the present petitioner - who is differently situated from the other accused and is in custody - is no longer required. Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Rishabh Chauhan @ Rishabh Chowhan shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the ACJM, Barrackpore.

If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned trial court and shall not leave the jurisdiction of North 24 Parganas without prior permission of the ld. ACJM, Barrackpore.

Accordingly, CRM(R) 29 of 2026 is allowed.
