Mihir Chakraborty v. State Of West Bengal & ANR
C.R.R. No.322 of 2015 With CRAN 1 of 2015 (Old CRAN 1436 of 2015) D/L 39 May 4, Bpg.
In Re: An application under Section 482 read with Section 397 of the Code of Criminal Procedure, 1973;
Sri Mihir Chakraborty
Versus
The State of West Bengal & Anr.
The revisional application was preferred challenging the proceedings relating to Case No.02/C/2015 under Section 138 of the Negotiable Instruments Act, 1881 pending before the learned ACJM, Kalyani, Nadia.
The revisional application appeared on 16th February, 2015 when a co-ordinate Bench of this Court was pleased to stay the proceedings for a period of ten weeks. Thereafter, the said interim order was never extended. There has been no persuasion at the instance of the petitioner.
The issues raised relate to question of facts, which do not make out an appropriate case for interference. Accordingly, CRR 322 of 2015 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
