Ld. Advocate for the State has submitted a report, which be kept with the record.

The report reflects that charge has already been framed in connection with the instant case and the next schedule has been fixed by the ld. Trial court on and from 5th of June, 2024.

It has been pointed out that 13 witnesses are to be examined in connection with the instant case. It is directed that on and from the next date, the ld. Trial court would fix a schedule consisting of three dates and fix such schedule once in every 45 days so that the trial of the case can be taken to its logical conclusion within a

reasonable period of time. No unnecessary adjournment be granted to any of the parties.

The Superintendent of Police of the concerned district on being intimated by the ld. Special Court will ensure regarding availability of the witnesses or, in the alternative, submit a report before the ld. Special Court assigning reasons for absence of the witnesses which are beyond control. No lame excuse be considered by the ld. Special Court for absence of any of the witness.

Ld. Public Prosecutor conducting the case will produce materials, exhibits and documents on the date so fixed for examination of the witnesses. All stakeholders would cooperate with the ld. Trial court to conclude the trial at the earliest.

With the aforesaid observations, CRR 818 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
