The petitioner is aggrieved by the fact that the private respondents with the aid of their associates are trying to block the free egress and ingress of the petitioner at his dwelling house and also enter his residence thereby injuring him. It has been pointed out that the petitioner happens to be a physically challenged person.

State has submitted a report which reflects that on 14.02.2025 on the basis of such information furnished by the wife of the present petitioner viz. One Arjina Bibi, Kandi Police Station Case No.

of was registered for investigation. Since the case has been registered and the process of investigation is on, police authorities would ensure that the petitioner is not further harassed at the hands of the private respondents.

The petitioner being physically

challenged, his free egress and ingress should be ensured until and unless a civil court has passed order in respect of the issues relating to ownership and/or changing the nature and character of the property complained of.

The police authorities would also ensure that no breach of the peace or tranquility takes place at the locale and/or any untoward incident results because of the inimical relationship existing between the petitioner and the private respondents. With the aforesaid observations, the writ petition being WPA 5246 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
