No. CRAN 1 of 2016 (Old CRAN 1375 of 2016) Akhtar Ali Khan -Vs.- The State of West Bengal This is an application filed under section 482 of the Code of Criminal Procedure by the petitioner for a direction as to why the proceeding being S.T. Case No. 97 of 2014 shall not be tried with G.R. Case No. 652 of 2014 (arising out of Nandigram Police Station Case No. 180 of 2015).

The matter was taken up by a coordinate Bench of this Hon'ble Court on August 10, 2015, when direction was given to the petitioner to serve a copy of the revisional application upon the opposite party/State and an interim order of stay of further proceeding was granted till the end of September, 2015.

By the order dated June 27, 2016, the Hon'ble coordinate Bench was pleased to dismiss the criminal revisional application for default and also vacated the interim order, as was directed. This revisional application was restored by the order dated August 5, 2016. The application for extension of interim order was also filed. However, no extension was granted by the Hon'ble Court. Thereafter the matter appeared before this Court on March 13, 2025. Pursuant to the direction of this Court, administrative notice was served upon the petitioner and the opposite party no. 2, which shows

that the present petitioner received the notice by putting up his signature therein.

None appears today on behalf of the parties.

In view of the long pendency of the matter and that administrative notice has since been served on the petitioner and the opposite party no. 2 and the nature of the prayer, as prayed for before the Hon'ble Court, this Court is not inclined to accommodate further. Accordingly, the instant revisional application being C.R.R. 341 of 2015 is dismissed for default.

Let a copy of the order be forwarded to the learned Trial Court for information.
