Banerjee) with CAN 1 of 2021 (Via Video Conference) Mr. Krishnendu Bhattacharya Ms. Priyanka Ganguly ... for the petitioner Mr. Sirsanya Banerjee Ms. Sudeshna Das Mazumder ... for the State This is a matter where the petitioner was not allowed to join the school despite he was exonerated of all criminal charges by this court as has been communicated to him by the West Bengal Board of Secondary Education through its letter dated 26.11.2021.
Today a copy of the said letter has been produced by the petitioner before this court which is kept on record.
Learned advocate for the District Inspector of Schools has submitted today that on 6th December, 2021 the headmaster wrote to the petitioner for joining the school and the District Inspector of Schools is not informed whether he has actually joined or not.
However, learned advocate for the petitioner submits that his client has joined the school on 7th December, 2021.
Therefore, the main grievance of the petitioner as to not allowing him to join the school has been redressed.
Now the only thing remains - payment of arrear salary to the petitioner.
I direct the school to take steps in this regard and to calculate the sum and to send it to the District Inspector of School's office by 60 days from date and the District Inspector of Schools is directed to see that the arrear salary is paid to the petitioner by 30 days thereafter.
The petitioner has submitted that according to him an amount of Rs. 25 lacs is due to him as he has not also been paid the subsistence allowance regularly. With the above direction and observation this writ application is disposed of.
With the disposal of the main writ application the connected application is disposed of.
