Advocate for the petitioner has expressed his anxiety as the petitioner is in custody since January, 2023. The records of the case reflect that charge has been framed in the month of January, 2024 and the next schedule has been fixed for examination of the witnesses on and from 5th of April, 2024. The prosecution in order to prove its case has relied upon 13 witnesses.
In view of the period of detention of the petitioner, I direct that the ld. Trial court would fix a schedule consisting of three dates and fix such schedule once in every two months for concluding the trial within a reasonable period of time. No unnecessary adjournment be granted to any of the parties.
If, any witness is absent, the ld. Special Court would communicate with the Superintendent of Police, Malda. The Superintendent of Police of the concerned district on being
intimated by the ld. Special Court will ensure regarding availability of the witnesses or, in the alternative, submit a report before the ld. Special Court assigning reasons for absence of the witnesses which are beyond control. No lame excuse be considered by the ld. Special Court for absence of any of the witness.
Ld. Public Prosecutor conducting the case will produce materials, exhibits and documents on the date so fixed for examination of the witnesses. All stakeholders would cooperate with the ld. Trial court to conclude the trial at the earliest.
With the aforesaid observations, CRR 821 of 2024 is disposed of.
Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
