Court No.13 Item No. 05 pk W.P.A. No. 3998 of 2020 Smt. Mahuya Bhattacharjee

Versus

The State of West Bengal & Ors.

Mr. Achyut Basu, Ms. Punm Basu ...For the petitioner.

Mr. Amitesh Banerjee, Mr. Tarak Karan ... For the State.

Mr. Billwadal Bhattacharyya, DSG Mr. Debanik Banerjee ... for the CBI.

Mr. Billwadal Bhattacharyya, learned Deputy Solicitor General (DSG) is present in Court.

This Court had, on an earlier occasion, received a very detailed report from the CID, West Bengal dated 30th September, 2022.

Mr. Achyut Basu, learned counsel for the petitioner would like to refer to some omissions in the report. This Court, however, finds that sufficient efforts have been put in by the CID, West Bengal. The purpose of transferring the investigation to the CBI is that the latter has a much wider network across the country. The CBI can also, if necessary, approach foreign agencies for the purpose of investigation. In those circumstances, the investigation shall now stand transferred to the CBI.

The D.D., CID, West Bengal, Nadia shall hand over the entire case diary, evidence, report and any other documents to the head of the Special Crime Branch, CBI, particularly the one dealing with missing persons.

With the aforesaid observations, the writ petition is disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
