For the petitioners This application relates to prayer for expeditious disposal of the suit as well as pronouncement of the order of an application under Order XXII Rule 4 of the Code of Civil Procedure heard on 8th September, 2017 but unfortunately no order has yet been passed on date. The contentious issue in this application does not require any service of notice upon the opposite parties. Thus, service of notice upon the opposite parties stands dispensed with.

The learned Civil Judge (Senior Division), 5th Court, Alipore, South 24-Parganas, is requested to pronounce the order of the application under Order XXII Rule 4 of the Code of Civil Procedure which was heard on 8th September, 2017, within 7 (seven) days from the receipt of this order. Learned Judge is also requested to dispose of the appeal, being Title Suit No.35 of 2009, after pronouncement of the order under Order XXII Rule 4 of the Code of Civil Procedure, as expeditiously as possible.

With the above observation, the revisional application, being CO 680 of 2023, stands disposed of. Learned advocate appearing on behalf of the petitioners is at liberty to bring this order to the notice of the learned Civil Judge (Senior Division), 5th Court, Alipore, South 24-Parganas, forthwith.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court without insisting upon production of a certified copy thereof.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
