22.03.2022 Ct. No 29 KAUSHIK (REJECTED) C.R.M. (A) 1329 of 2022 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Nabadwip Police Station Case No. 208 of 2021 dated 22.05.2021 under Sections 420/406/323/354/340 of the Indian Penal Code, 1860.

And In Re : Sri Amal Kumar Saha ..... petitioner Mr. S. Halder Mr. Tathagata Majumdar .... for the petitioner Mr. Madhusudan Sur Mr. Manoranjan Mahata ... for the State Petitioner renews the prayer for anticipatory bail. Learned advocate appearing for the petitioner submits that, subsequent to the earlier order of rejection dated September 20, 2021 passed in CRM 5803 of 2021, there is no further development so far as the investigations are concerned. Learned advocate appearing for the State submits that, the police are yet to file charge-sheet. There is hardly any material change in circumstances since the earlier order of rejection of the prayer for anticipatory bail. Considering the fact that the prayer for anticipatory bail was rejected by the Coordinate Bench on September 20, 2021 passed in CRM 5803 of 2021 and considering the fact that there is hardly any material change in circumstances warranting this Hon'ble Court to do so, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 1329 of 2022 stands dismissed.
