Affidavit of service so filed be kept with the record. The present revisional application has been preferred for expeditious disposal of NDPS Case No. 48 of 2023 arising out of Rejinagar P. S. Case No. 99 of 2023 dated 16-04-2023. Report submitted by O/C, Rejinagar PS, Murshidabad PD through the learned advocate for the State be kept with the record. Report reveals that the next date has been fixed on 22nd May, 2024 for consideration of charges.
Learned advocate for the petitioners submits that there are 16 witnesses on whom the prosecution has relied upon to prove its case. In view of the petitioners being in custody for about 11 months and date for consideration of charges being fixed on 22nd May, 2024. The learned Special Court would frame charges on the next date or within a fortnight thereafter. The learned special court thereafter would fix a schedule consisting of three dates and fix such schedule once in every 75 days so that the trial of the case can be taken to its logical conclusion within a reasonable period of
time.
In case, if any witness is not available, the Superintendent of Police, Murshidabad District be communicated who would ensure the availability of the witness concerned and in case of non-availability, submit a report before the court assigning the reasons for absence. The learned special court will not accept any lame excuse by any departmental witness for evading the process of court.
No unnecessary adjournments should be granted to either of the parties.
The Public Prosecutor appearing in the case would produce the materials, documents and exhibits on the dates fixed for examination of the witnesses concerned. All efforts be taken by the stake-holders to cooperate with the trial court so that the trial is concluded at the earliest.
The proceedings of the present case would continue in spite of any resolution of the local Bar and none of the advocates representing the parties would deter or stall the progress of the case on such dates.
With the aforesaid observations, the present revisional application being CRR 823 of 2024 is disposed of. Pending applications, if any, are consequently disposed of.
