The grievance of the petitioners is both of them are Assistant Teachers of Rangamati Kiranmoyee High School (HS) Paschim Medinipur (hereinafter referred to as 'said school') and they offered their candidature in the selection process which was conducted by the said school authority for filling up the post of Assistant Headmaster. Date of interview was fixed on 23rd September, 2024 but interview could not be conducted since the headmaster fell ill as it appears from a
document at page 69 of the writ petition.
Petitioners pray for direction upon the District Inspector of Schools (SE) Paschim Medinipur being respondent no. 3 to give necessary direction for holding postponed interview for filling up the post of Assistant Headmaster of the said school in terms of Clause of the Guidelines for Recruitment of Assistant Headmaster/Assistant Headmistress of Recognised Aided NonGovernment Secondary Schools/Higher Secondary Schools, Government Sponsored School and all types of Recognised & Aided Madrasahs as notified vide memo dated 10th July, 2002.
Mr.
Supriyo Chattopadhyay, learned Additional Government Pleader has made submission based on the report filed in the form of affidavit today and it is submitted that there are certain irregularities for which at the material point of time permission could not be accorded to hold postponed interview.
In spite of repeated service of notices said school authority remains unrepresented.
Taking note of the submissions made on behalf of the petitioners and State respondents it appears that till date vacant post of Assistant
Headmaster in the said school has not been filled up due to want of necessary permission to be issued by the respondent no. 3.
No useful purpose would be sub served in keeping the writ petition pending.
Respondent no. 3 is directed to take decision after hearing the petitioners and headmaster of the said school and other interested parties within a period of 8 (eight) weeks from the date of communication of this order and a reasoned order shall be passed in terms of the relevant provisions of the guidelines for recruitment of the Assistant Headmaster as notified vide memo dated 10th July, 2002. Decision to be taken by the respondent no. 3 shall be communicated to the parties by 10 days thereafter.
Writ petition stands disposed of.
Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
