None represents the respondents.

The petitioners pray for a direction upon the Commissioner, Panchayat and Rural Development Department to clarify the position as sought for by the Additional District Magistrate (P), Malda vide communication dated 16th October, 2023.

The matter relates to selection of the leader of the opposition in Daulatnagar Gram Panchayat under Harishchandrapur-II Development Block, Malda. As it appears that the request made by the Additional District Magistrate (P), Malda is pending consideration before the Commissioner, Panchayat and Rural Development Department for a considerable period of time, accordingly, the instant writ petition is disposed of by directing the Commissioner being the respondent no. 2 herein to take a call in accordance with law and thereafter communicate the decision to the necessary parties at the earliest but positively

within a period of four weeks from the date of communication of this order.

Learned advocate appearing for the petitioners is directed to forward all the relevant documents in connection with the prayer made to the aforesaid respondent at the time of communicating the order of the Court.

It is made clear that this Court has not entered into the merits of the claim of the petitioners and all points are left open to be decided by the aforesaid respondent at the time of consideration of the request made by the Additional District Magistrate (P), Malda. The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
