Learned advocate appearing for the complainant/petitioner is aggrieved by the fact that even after five years of Case No. CR-386 of 2018 having been filed, there has been no progress in the case and in fact, the evidence has not commenced. It has been pointed out that the accused/opposite party no.2 is filing application for protracting the trial of the case and the case cannot proceed substantially.

Having considered the plight expressed on behalf of the petitioner, I direct the learned Magistrate to dispose of the pending petition within one month of the next date so fixed and thereafter proceed with the trial of the case by fixing at least one date in every 45 days so that trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment should be granted to either of the parties.

The learned Magistrate is, however, directed that if a witness is present, then in that case in spite of resolution of the local Bar, under no circumstances the witness should go back and the learned advocates representing the respective parties would continue with the trial of the case.

All efforts be taken so that trial of the case is concluded at the earliest.

With the aforesaid observations, the revisional application being CRR 828 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
