For the petitioner The prayer in this application under Article 227 of the Constitution of India is for expeditious disposal of one application under Order VII Rule 11 of the Code of Civil Procedure filed by the petitioner in connection with Title Suit No.1197 of 2022 on 9th September, 2022.

Learned advocate appearing on behalf of the petitioner has submitted that the application under Order VII Rule 11 of the Code of Civil Procedure is required to be heard within a specified time period.

Considering the nature of prayer, i.e., expeditious disposal, I find hardly any necessity to ask for service of notice upon the opposite party. Thus, service of notice upon the opposite party stands dispensed with. The learned Civil Judge (Senior Division), 4th Court, Alipore, is requested to dispose of the application under Order VII Rule 11 of the Code of Civil Procedure prior to

hearing of any other applications, as expeditiously as possible.

With the above observation, the revisional application, being CO 684 of 2023, stands disposed of. Learned advocate appearing on behalf of the petitioner is at liberty to bring this order to the notice of the learned Civil Judge (Senior Division), 4th Court, Alipore, forthwith.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court without insisting upon production of a certified copy thereof.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
