Considering the urgency pleaded by the petitioner in CAN 5015 of 2020, the instant writ petition is taken up for hearing via video conference. Accordingly, the application being CAN 5015 of 2020 is disposed of.

The petitioner's grievance is that he had applied for sanction of a plan for construction of a building at Premises No. 53/A, Upendra Deb Sarani but the same has not been considered till date.

Counsel for the Howrah Municipal Corporation submits that there were certain disputes and civil proceedings between the petitioner and his neighbours, as a consequence whereof, the matter could not be taken up.

Mr. Chatterjee, learned advocate appearing for the petitioner submits that there are no civil proceedings any further pending and that the Howrah Municipal Corporation should consider his application for sanction of a building plan expeditiously. Having considered the facts of this case, the petitioner shall within a period of seven days submit a fresh application to the Howrah Municipal Corporation for sanction of a building plan where upon the Howrah Municipal Corporation shall take a suitable decision on the same within a period of six weeks thereafter. The said decision may be communicated to the petitioner within seven days thereof.

With the aforesaid directions, the instant writ petition is disposed of.

No order as to costs.

Since no affidavits have been used by the respondents, no allegation contained in the writ petition shall not be deemed to have been admitted. All parties are to act on a server copy of this order on the usual undertakings.
