Petitioner is aggrieved by the fact that the representation dated 12.02.2025 addressed to the Officer-in-Charge, Kasba Police Station as also the superior officer of police did not yield any result. It has been submitted that Title Appeal No.74 of 2022 is pending and there is an order of status quo passed by the appellate court.

Learned advocate for the State has submitted two reports prepared by the Officer-in-Charge, Kasba Police Station as also the Special Land Acquisition Officer, 24 Parganas (South).

Having considered that the civil court is already in seisin of the issue, I direct that if there is any breach of the order of the civil court, the concerned court would address the issue and pass a

specific direction upon the police authorities. It has been brought to the notice of the Court that similar order was passed on 29.03.2025.

Having considered that there has been hardly any change of circumstances since the last order was passed, I reiterate that the petitioner would follow the directions passed in WPA 27569 of 2022 and/or in the alternative approach the appellate forum in seisin of the civil dispute.

With the aforesaid observations, WPA 5112 of 2025 is disposed of.

Report so submitted be kept with the record.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
