The affidavit of service is taken on record.

The petitioner seeks an assessment of his status as a State Aided College Teacher, Category-II in terms of a Memorandum of the Higher Education Department (College Sponsored Branch), Government of West Bengal, dated 23rd December, 2019.

According to learned counsel appearing for the petitioner, the names of other teachers of the concerned College were sent by the College Authority to the State within the prescribed time limit, which was 25th September, 2019. However, the petitioner's name was sent only on 28th September, 2020.

Learned counsel appearing for the State submits that the facts involve of an online application and the relevant portal is closed. It is also submitted that there is no provision for entertaining any further application.

W.P.A.4818 of 2022 is disposed of with a direction on the Director of Public Instruction, Government of West Bengal being respondent no.3 to consider the recommendation of the aided College dated 28th September, 2020 within a period of four weeks from the date of communication of this order and pass a reasoned order after hearing all relevant parties including the petitioner in accordance with law. A copy of the reasoned order shall be made available to the petitioner within a week from which such order is passed.

Since affidavits have not been called for, the allegations made in the writ petition are deemed not to be admitted.

Urgent photostat certified copy of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
